Terms and Conditions

1. Acceptance of Terms

By accessing and using the MCE Printing, LLC ("MCE Printing", "we", "us") website (mceprinting.com) and services, you accept and agree to be bound by the terms and provision of this agreement. In addition, when using these services, you shall be subject to any posted guidelines or rules applicable to such services. Any participation in this service will constitute acceptance of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Orders and Production

All orders placed with MCE Printing are custom-made to your specifications. Due to the custom nature of our products:

  • Immediate Production: Production may begin immediately upon your submission of an order or approval of a proof.
  • Cancellations: You may cancel your order only before production has begun. Once your order has entered the production phase, it cannot be canceled, and no refunds will be issued.
  • Refund Policy: We do not offer refunds on custom printed products once production has started. If there is a manufacturing defect with your order, please contact us within 14 days of receipt.
  • Right to Refuse Service: We reserve the right to refuse to print any order that we, in our sole discretion, determine contains illegal, offensive, or otherwise inappropriate content. We are not liable for any costs or damages resulting from our refusal to process such orders.

3. Proofing and Approval

You are solely responsible for the final review and approval of your project proofs.

  • Explicit Confirmation: Your approval of a proof is your explicit confirmation that you have reviewed every single page, image, and text element for accuracy.
  • Responsibility: MCE Printing is not responsible for errors that you have approved, including but not limited to typos, layout issues, low-resolution images, or missing content.
  • Color Accuracy: We strive for high-quality color reproduction. However, due to differences in monitor calibration and printing processes, we are not responsible for color shifts, variations, or differences between what you see on your screen and the final printed product.

4. Abandoned Orders

To ensure efficient operations, we have specific policies regarding orders that are not picked up or completed:

  • Local Pickup: Orders designated for local pickup that are not collected within 24 days of notification of completion will be considered abandoned and may be disposed of without refund or compensation.
  • Online Orders: Paid online orders that remain unconfirmed, have pending artwork issues, or are otherwise stalled due to customer inaction for more than 60 days will be considered abandoned and canceled without refund.

5. Shipping, Taxes, and Customs

You are responsible for paying all applicable taxes, shipping costs, and fees associated with your order.

  • Taxes: Sales tax will be calculated and collected at checkout where applicable by law.
  • International Shipping: For international orders, you are the importer of record and must comply with all laws and regulations of the destination country. You are responsible for any import duties, taxes, and customs clearance fees that may apply. Delays caused by customs processes are beyond our control.

6. Reporting Issues and Defects

It is your responsibility to inspect your order upon receipt. Any claims regarding your order must be made in writing within the following timeframes:

  • Damaged or Missing Items: Must be reported within 5 days of delivery.
  • Quality Defects: Must be reported within 10 days of delivery.

Failure to report issues within these timeframes constitutes your acceptance of the order as delivered.

7. Intellectual Property and Content License

You retain full ownership of the content you submit to MCE Printing. We do not claim any ownership rights to your text, images, or designs.

By submitting content to us, you grant MCE Printing a non-exclusive, worldwide, royalty-free, transferable license to use, reproduce, modify, adapt, publish, and display such content solely for the purpose of providing our services to you, including producing and shipping your order. You represent and warrant that you have all necessary rights to grant this license and that your content does not infringe on the rights of any third party.

8. Indemnification

TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS MCE PRINTING, LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES FROM AND AGAINST ANY AND ALL CLAIMS, LIABILITIES, DAMAGES, LOSSES, COSTS, EXPENSES, OR FEES (INCLUDING REASONABLE ATTORNEYS' FEES) THAT SUCH PARTIES MAY INCUR AS A RESULT OF OR ARISING FROM: (I) YOUR USE OF THE WEBSITE OR SERVICES; (II) YOUR VIOLATION OF THESE TERMS; (III) YOUR VIOLATION OF ANY RIGHTS OF ANY OTHER PERSON OR ENTITY; OR (IV) ANY CONTENT PROVIDED BY YOU, INCLUDING BUT NOT LIMITED TO CLAIMS OF COPYRIGHT INFRINGEMENT, TRADEMARK INFRINGEMENT, OR DEFAMATION.

9. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration in King County, Washington, before one arbitrator. Judgment on the award may be entered in any court having jurisdiction. This clause shall not preclude parties from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction.

Class Action Waiver:

You agree that any arbitration or proceeding shall be limited to the dispute between us and you individually. To the full extent permitted by law, (i) no arbitration or proceeding shall be joined with any other; (ii) there is no right or authority for any dispute to be arbitrated or resolved on a class-action basis or to utilize class action procedures; and (iii) there is no right or authority for any dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.

10. User Accounts

If you create an account on the Website, you are responsible for maintaining the security of your account and you are fully responsible for all activities that occur under the account. You must immediately notify us of any unauthorized uses of your account or any other breaches of security.

11. Limitation of Liability

In no event shall MCE Printing, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of the Service. Our total liability for any claim arising out of or relating to these Terms or our Services shall not exceed the amount paid by you for the specific order giving rise to the claim.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the state and federal courts located in King County, Washington for any actions for which we retain the right to seek injunctive or other equitable relief in a court of competent jurisdiction.

13. Changes to This Agreement

We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions by posting the updated terms on the Website. Your continued use of the Website after any such changes constitutes your acceptance of the new Terms and Conditions.
